Staying at Highgate House means that you have the 24/7; 365 days a year back up and support of a premier vacation home agency (often referred to in these terms and conditions as the management agents or as our representatives), but also the family touch and personal care provided by The McComish Family. Details regarding the agency are provided when booking.

To book a stay at The Villa simply Contact Us.

After making a reservation with us, the party leader must complete our booking form (we will provide you with this) and sign on behalf of all members of the party that these booking conditions together with our general information have been read and accepted.

The accommodation is booked solely for the use of the guests named on the booking form. Due to State fire regulations in Florida, the maximum occupancy as advised by us (10 people) must not be exceeded.

To confirm your booking, we will require a non-refundable deposit of £100 within 7 days of our verbal confirmation of your arrangements (unless arranged otherwise during the booking process). A higher deposit may be required for premium dates or for longer stays.

Your booking is confirmed once we have received your deposit and booking form, and the confirmation invoice has been issued by us. No further invoice will be issued, therefore please make a note of the balance due date.

The following Booking Terms and Conditions apply when booking a stay with us so please read very carefully.

Terms and Conditions:-

• The following booking conditions form the basis of your contract. All bookings are subject to these booking conditions. The parties to that contract are yourselves and McComish Holiday Villas.
• The amount of deposit required to secure your booking is £100 and this should be received within seven days of your written or verbal agreement to rent the villa. This deposit is non refundable.
• The balance of payment is due eight weeks before your arrival at which time the security deposit of £150 is also required.
• If you need to cancel your booking you must give notice in writing either by registered post or confirmed e-mail. The booking will only be cancelled on the date the written cancellation is received. The following cancellation charges will apply:-
  
  • Eight weeks or more notice - Deposit only
  • 4-8 weeks notice - 50% refund
  • 2-4 weeks notice - 25% refund
  • 2 weeks or less notice - No refund
  
  Regrettably flight delays and cancellations do not constitute cancellation of your booking with us and full payment is still due. In this situation you would need to seek compensation from either your airline or travel insurance.
• Any cleaning charges due are payable locally unless otherwise specified at the end of your stay.
• Any breakages or damage must be notified immediately either to ourselves or our representatives.
• Under no circumstances should any pool controls be touched or tampered with. If you have cause for concern ourselves or our representatives should be notified immediately.
• Anyone found to be causing nuisance or damage will be evicted without notice.

Where payment in full has not been made by this date, we reserve the right to cancel the booking and cancellation charges will apply.

If you book within 8 weeks of your stay, we will require full payment at the time of booking.

Please remember that your security deposit is also due when you pay the balance.

We endeavour to ensure that the prices displayed on this website are correct but we do not guarantee this. Please contact us for an accurate quote.

Rentals paid for IN FULL at the time of booking will not be subject to any increase or surcharge.

*This includes: prices per week, booking deposits, security deposits, cleaning charges and any other price that may be displayed on this website.

Your holiday home is cleaned and prepared for your arrival. Maid service however is not usual in Florida private homes and it's therefore up to you to keep the property clean and to change and wash bed linen and towels (which are supplied, as are utilities) during your stay.

We ask that you vacate the property by 10.00am on the day of your departure, leaving it in a tidy condition to enable our cleaners to prepare for our newly arriving guests.

There is also a returnable security deposit. Please see below for details on this.

When paying the full balance we will require the payment of a returnable security deposit of £150* (GBP) . This charge will be held to cover or part cover any breakages, excess cleaning costs or damage to the property.

The deposit will be returned by us after your stay, subject to inspection by the management company, less any deductions to cover the cost of replacement or repair. Costs in excess of this amount will be invoiced and payable in full immediately.

*As with all amounts shown on this website we do our very best to ensure that they are correct, however we do not guarantee this. This figure is not binding and is subject to change without notice.

Changes within 8 weeks may result in additional cancellation charges. (Detailed in the 'Your Booking' section above, click the link for details).

IF WE CHANGE YOUR BOOKING:

Occasionally it may be necessary for us to amend or cancel your booking through reasons beyond our control and we reserve the right to do so.

We will inform you as soon as possible, and if possible will offer you the choice of alternative accommodation of a similar standard, or a refund of all monies paid, providing it does not arise for reasons of 'Force Majeure'.

• Eight weeks or more notice - Deposit only
• 4-8 weeks notice - 50% refund
• 2-4 weeks notice - 25% refund
• 2 weeks or less notice - No refund

These include, but are not limited to: war, threat of war, riots, civil commotion, terrorist activities, industrial disputes, technical difficulties with transportation, natural disasters, nuclear disasters, fire, volcanic eruptions, adverse weather conditions or other events outside our control.

If you have a problem during your stay, you MUST inform the management agency immediately who will endeavor to rectify the matter.

We will not accept liability for any dissatisfaction or other complaint not reported to the local managing agent during your stay.

No responsibility or liability is accepted for any death, illness, injury or loss or damage to property and/or motor vehicles howsoever caused.

What constitutes 'Gross Misconduct' is at our (McComish Holiday Villas and/or the management agents) discretion and includes, but is not limited to: willful damage to property, extreme noise pollution, violence or aggression and breaking the law. Any instances of Gross Misconduct during your stay will not be tolerated.

Anyone found to be causing nuisance or damage will be evicted without notice.

Where keys are provided in a 'lock box' facility you will be given a security code. The security code will be needed in order to allow you to access the security box, which holds the keys to your home. The security box is easy to access and can be found at the entrance to the property.

Please remember to take these details with you otherwise access to the villa cannot be guaranteed.

The Villa is our own holiday home and is furnished to our taste, and changes may be made without notice.

No liability is accepted for unintentional errors, mistakes, or omissions, which may arise as a result of subsequent changes.

By using or browsing this site ("the Site"), we take it that you have read, understood and agree to be bound by these Terms and Conditions and any other guidelines or rules applicable to other services that may be posted from time to time. If you do not agree with any part of the following terms of conditions you must not use the Site. If you are uncertain, you can always contact us.

Our Obligations

McComish Holiday Villas will respond to any e-mails, telephone calls or answer phone messages that are successfully received.

Wherever possible we aim to respond to these enquiries quickly, generally within 48 hours . Unfortunately however this cannot be guaranteed, but every effort will be made to respond to queries in a timely manner. We can take no responsibility for e-mails/calls/messages that are not received due to information technology failures that are outside of our control. If you have received no response to your query within 96 hours (4 days) we recommend contacting us again, in case there was a problem with us receiving your original query.

McComish Holiday Villas and their designated Web Developer/Web Development Company (currently Tara Shannon) aim to provide you with up to date information on the Villa and the functionality of the Site, and on any upgrades or changes to its functionality; and use reasonable endeavors to comply with any statute, regulation or other ordinance as and when they come into force.

Your Obligations

You agree that you will only use the Site in accordance with these Terms and Conditions and shall ensure compliance with applicable laws and regulations.

You represent, warrant and undertake that you will not cause or permit anything to be done that may infringe, damage or endanger any intellectual property rights of McComish Holiday Villas or any third party.

You agree that you will only use the McComish contact details (e.g. e-mail and telephone) for genuine queries related to the Villa and the Site. You agree not to use any obscene, offensive or threatening language within queries. We will not respond to queries that do not comply with this rule and reserve the right to cancel your booking. Use of contact details for other purposes including unsolicited commercial marketing is strictly prohibited.

You agree that you will only use the Web Developers details (e-mail) for queries related to the website. You agree not to use any obscene, offensive or threatening language within queries. The web developer will not respond to queries that do not comply with this rule and reserves the right to inform us (the McComish family) of such behaviour so that if applicable we may cancel your booking. Use of the web developers contact details for other purposes including unsolicited marketing is strictly prohibited.

Exclusion of Warranty

We try to make sure the information contained on this Site is as accurate as possible. However we give no warranty of any kind regarding the Site and/or any materials or information provided on the Site. McComish Holiday Villas and their web developer do not warrant the accuracy, completeness, currency, or reliability of any of the content or data found on this Site and to the extent permitted by law McComish Holiday Villas and their web developer expressly disclaims all warranties and conditions, including implied warranties and conditions or merchantability, fitness for a particular purpose and non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade.

McComish Holiday Villas and their web developer assume no responsibility and shall not be liable for any damage to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site. In no event shall McComish Holiday Villas or their web developer be liable for any injury, loss, claim, damage, or any exemplary, punitive, indirect, incidental or consequential damages of any kind (including but not limited to lost profits or lost savings) whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with:

You shall indemnify and keep McComish Holiday Villas and their web developer indemnified against all actions, claims, losses, costs (including all legal costs actually incurred or otherwise), damages and expenses that are suffered or incurred by McComish Holiday Villas and their web developer and any affiliated or associated company or entity whether or not reasonable or otherwise foreseeable or avoidable which arise directly or indirectly from any breach or alleged breach by you of any of these Terms and Conditions.

Affiliates/links to other Sites

We may provide links to other Sites, resources, advertisements or sponsorships. McComish Holiday Villas accepts no responsibility for these links and does not endorse their contents. If you decide to access other web sites, you do so at your own risk.

As mentioned above any dealings you have with third parties via the Site are your responsibility. Should a dispute arise between yourself and any third party due to use of the Site we will not be responsible for any loss or damage suffered as a result.

Broken Links

We check all links to other sites regularly to ensure that they are working. However as they link to external sites over which we have no control, then sometimes, when one of these external sites are updated or changed, the link we have provided may stop working or "break". Whilst we endeavor to ensure that you will not encounter broken links we cannot guarantee this. If you do come across a link that is not working we apologise and would greatly appreciate it if you could contact our web developer to advise them of this fact so they can rectify it as soon as possible. The Site and each of its modules, including but not limited to text, graphics, logos, button icons, images, audio clips and software, is the property of McComish Holiday Villas and Tara Shannon (the web developer). They are free source meaning that they can be reproduced, hence (when following Googles T's and C's) we can use them on this site, but the copyright remains with Google and you cannot reproduce these without first consulting Googles terms and conditions to ensure you are not in breach.

However we may use your details to contact you with offers regarding our Villas that we feel you may be interested in.
