By browsing the site we take it that you have read the Terms and Conditions (T's & C's) and agree to them.
Having read the T's & C's, if you then wish to quickly check a particular aspect of the Terms and Conditions we have provided a menu to make it easier to navigate and find the information you require.
If you are intending to book a stay at the Spanish Villa, then please ensure that you take the time to read through these Terms and Conditions, thank you.

The McComish Spanish Holiday Villa is a subsidiary of McComish Holiday Villas.
Other subsidiaries of the McComish Holiday Villas Group are The McComish Florida Holiday Villa. |

| The Agency |
|
|
The McComish Spanish Holiday Villa at La Torre is not managed by a vacation home agency. However we do have people in our employ who clean and inspect the Villa inbetween guests. (We may refer to them in these terms and conditions as the management agents).
Staying at The Villa means you can enjoy the family touch and personal care provided by The McComish Family.

| Your Booking |
|

|
To book a stay at The Villa simply Contact Us.
The following Terms and Conditions apply when booking a stay with us so please read carefully.
Terms and Conditions:-
- The following booking conditions form the basis of your contract. All bookings are subject to these booking conditions. The parties to that contract are yourselves and McComish Holiday Villas.
- The amount of deposit required to secure your booking is £100 and this should be received within seven days of your written or verbal agreement to rent the villa. This deposit is non refundable.
- The balance of payment is due eight weeks before your arrival at which time the specified security deposit is also required.
- If you need to cancel your booking you must give notice in writing either by registered post or confirmed e-mail. The booking will only be cancelled on the date the written cancellation is received. The following cancellation charges will apply:-
- Eight weeks or more notice - Deposit only
- 4-8 weeks notice - 50% refund
- 2-4 weeks notice - 25% refund
- 2 weeks or less notice - No refund
Regrettably flight delays and cancellations do not constitute cancellation of your
booking with us and full payment is still due. In this situation you would need to
seek compensation from either your airline or travel insurance.
- Any cleaning charges due are payable locally unless otherwise specified at the end of your stay.
- Any breakages or damage must be notified immediately either to ourselves or our representatives.
- Under no circumstances should any pool controls be touched or tampered with. If you have cause for concern ourselves or our representatives should be notified immediately.
- Anyone found to be causing nuisance or damage will be evicted without notice.
The following information is also relevant.
After making a reservation with us, the party leader must complete our booking form (we will provide you with this) and sign on behalf of all members of the party that these booking conditions together with our general information have been read and accepted.
The accommodation is booked solely for the use of the guests named on the booking form. Due to fire regulations in Spain, the maximum occupancy as advised by us (6 people) must not be exceeded.
As mentioned earlier in order to confirm your booking, we will require a deposit of £100.00 within 7 days of our verbal confirmation of your arrangements (unless arranged otherwise during the booking process). Please note that a higher deposit may be required for premium dates or for longer stays exceeding 4 weeks.
Your booking is confirmed once we have received your deposit and booking form, and the confirmation invoice has been issued by us. No further invoice will be issued, therefore please make a note of the balance due date.

| Paying the Balance
|
|
|
The balance of your rental cost is payable 8 weeks prior to your arrival in Spain .
Where payment in full has not been made by this date, we reserve the right to cancel the booking and cancellation charges will apply.
If you book within 8 weeks of your stay, we will require full payment at the time of booking.
Please remember that your security deposit is also due when you pay the balance. |

| Price Guarantee |
|
|
All prices are subject to change without notice.
Rentals paid for IN FULL at the time of booking will not be subject to any increase or surcharge. |
|
| What's included |
|
|
You have use of the property including all utilities.
Your holiday home is cleaned and prepared for your arrival. There is an €90.00 charge for this cleaning service which is not included in the prices per week detailed on this site, so remember to factor this in when calculating the cost of your stay, (please remember the charge is in Euros so check the current exchange rate to see how much this is in your currency). This is payable locally at the end of your stay.
Maid service however is not usual in Spanish Villas and it's therefore up to you to keep the property clean and tidy and to change and wash bed linen and towels (which are supplied, as are utilities) during your stay. However if you wish a Maid Service can be arranged for you for an extra charge.
For those with small children a highchair and stair guard can be made available at no extra cost. Please inquire when booking.
There is also a returnable security deposit of £150.00. Please see below for details on this. |

| Security Deposits |
|
|
We understand that accidents do happen, but we do ask that you inform us or the management agents (details provided when booking) of any defects or breakages immeadiately and pay for the repair or replacement so that neither you nor the following guests are inconvenienced.
When paying the full balance we will require the payment of a returnable security deposit of £150.00 (GBP) . This charge will be held to cover or part cover any breakages, excess cleaning costs or damage to the property.
The deposit will be returned within 21 days of the end of the rental period subject to inspection by the management company, less any deductions to cover the cost of replacement or repair. Costs in excess of this amount will be invoiced and payable in full immediately. |

| Changing Your Booking |
|
|
Any amendment made by you to a confirmed booking may incur a charge.
Changes within 8 weeks of your stay may result in additional cancellation charges.
IF WE CHANGE YOUR BOOKING:
Occasionally it may be necessary for us to amend or cancel your booking through reasons beyond our control and we reserve the right to do so.
We will inform you as soon as possible, and if possible will offer you the choice of alternative accommodation of a similar standard, or a refund of all monies paid, providing it does not arise for reasons of 'Force Majeure'. |

| Cancellation |
|
|
If you need to cancel your booking you must give notice in writing either by registered post or confirmed e-mail. The booking will only be cancelled on the date the written cancellation is received. The following cancellation charges will apply:-

| Changeover Day |
|
|
Changeover day is flexible.
Arrival is after 3pm and departure by 12 noon unless prior arrangements have been made. Please let us know when booking or as soon as possible thereafter if you require flexibility on changeover day. So long as we have enough notice we will try to oblige you.
Please note however that if you wish to leave very late on changeover day, we may have to charge for another night, as we will not be able to rent the Villa until the next day.
If you wish to alter arrangements for changeover day within the 8 weeks prior to your arrival this may not be possible. |

| Force Majeure |
|
|
No liability can be accepted for events, which are 'force majeure'.
These include, but are not limited to: war, threat of war, riots, civil commotion, terrorist activities, industrial disputes, technical difficulties with transportation, natural or nuclear disaster, fire, adverse weather conditions or other events outside our control. |

| Liability |
|
|
| We accept no liability whatsoever for any injury or loss sustained by guests or any other visitors to the home, grounds or swimming pool, or for any loss or damage howsoever caused to any property brought to the premises. |
|
| In Case of Complaint |
|
|
While it is highly unlikely that you should have a complaint about our Villa, occasionally things do go wrong.
If you have a problem during your stay, you MUST inform us or the managing agent immediately who will endeavor to rectify the matter.
We will not accept liability for any dissatisfaction or other complaint not reported to us or the local managing agent during your stay. |

| Insurance |
|
|
It is vital that you have adequate comprehensive insurance cover for you and all members of your party.
Check that any policies you are considering do in fact cover you for rented accommodation booked independently of travel arrangements.
No responsibility is accepted for any death, illness or loss or damage to property and/or motor vehicles howsoever caused. |

| Conduct |
|
|
McComish Holiday Villas and/or the management agents reserve the right to cancel your booking or to terminate your stay if we (McComish Holiday Villas and/or the management agents) believe that your conduct breaches these terms & conditions or we (McComish Holiday Villas and/or the management agents) believe that gross misconduct has occurred.
What constitutes 'Gross Misconduct' is at our (McComish Holiday Villas and/or the management agents) discretion and includes, but is not limited to: willful damage to property, extreme noise pollution, violence or aggression and breaking the law. Any instances of Gross Misconduct during your stay will not be tolerated.
Anyone found to be causing nuisance or damage will be evicted without notice. |

| Departure Documentation |
|
|
Approximately 30 days before arrival, you will be sent details, giving directions to the vacation home and information on key collection.
Please remember to take these details with you otherwise access to your vacation home cannot be guaranteed. |

Our web site is a guide to the quality and description of our Villa and its facilities.
This property is privately owned and furnished to the owners taste, and changes may be made without notice.
No liability is accepted for unintentional errors, mistakes or omissions, which may arise as a result of subsequent changes.
By using or browsing this site ("the Site"), you have read, understood and agree to be bound by these Terms and Conditions and any other guidelines or rules applicable to other services that may be posted from time to time. If you do not agree with any part of these terms of conditions you must not use the Site, or book a stay at the Villa. If you are uncertain, you can always contact us.
Our Obligations
McComish Holiday Villas and their designated Web Developer/Web Development Company (currently Tara Shannon) will provide you with up to date information on the functionality of the Site, and advice and assistance on any upgrades or changes to its functionality; and use reasonable endeavors to comply with any statute, regulation or other ordinance as and when they come into force.
McComish Holiday Villas will respond to any e-mails, telephone calls or answer phone messages that are successfully received.
Wherever possible we aim to respond to these enquiries quickly, generally within 48 hours . Unfortunately however this cannot be guaranteed, but every effort will be made to respond to queries in a timely manner. We can take no responsibility for e-mails/calls/messages that are not received due to information technology failures that are outside of our control. If you have received no response to your query within 96 hours (4 days) we recommend contacting us again, in case there was a problem with us receiving your original query.
Your Obligations
You agree that you will only use the Site in accordance with these Terms and Conditions and shall ensure compliance with applicable laws and regulations.
You represent, warrant and undertake that you will not cause or permit anything to be done that may infringe, damage or endanger any intellectual property rights of McComish Holiday Villas or any third party.
You agree that you will only use the McComish contact details (e-mail and telephone) for queries related to the Villa, the surrounding area (Spain) and the Site. You agree not to use any obscene, offensive or threatening language within queries. We will not respond to queries that do not comply with this rule and reserve the right to cancel your booking.
Exclusion of Warranty
We try to make sure the information contained on this Site is as accurate as possible. However we give no warranty of any kind regarding the Site and/or any materials or information provided on the Site. McComish Holiday Villas does not warrant the accuracy, completeness, currency, or reliability of any of the content or data found on this Site and to the extent permitted by law McComish Holiday Villas expressly disclaims all warranties and conditions, including implied warranties and conditions or merchantability, fitness for a particular purpose and non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade.
McComish Holiday Villas assumes no responsibility and shall not be liable for any damage to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site. In no event shall McComish Holiday Villas be liable for any injury, loss, claim, damage, or any exemplary, punitive, indirect, incidental or consequential damages of any kind (including but not limited to lost profits or lost savings) whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with:
- any use of this Site or content found herein
- any failure or delay (including, but not limited to) the use of or inability to use any component of the Site
- the performance or non-performance by mccomishholidayvillas.com even if such party has been advised of the possibility of damages to such parties or any other party
- the provision of or failure to provide services
- any information, software, products, services and related graphics obtained through the Site
Any dealings you have with third parties via the Site are your responsibility. Should a dispute arise between yourself and any third party due to use of the Site we will not be responsible for any loss or damage suffered as a result.
Affiliates/links to other Sites
We may provide links to other Sites, resources, advertisements or sponsorships either directly or through the contractual partners. McComish Holiday Villas accepts no responsibility for these links and does not endorse their contents. If you decide to access other web sites, you do so at your own risk whatsoever. You shall indemnify and keep McComish Holiday Villas indemnified against all actions, claims, losses, costs (including all legal costs actually incurred or otherwise), damages and expenses that are suffered or incurred by McComish Holiday Villas and any affiliated or associated company or entity whether or not reasonable or otherwise foreseeable or avoidable which arise directly or indirectly from any breach or alleged breach by you of any of these Terms and Conditions.
Copyright & Trademark
The Site and each of its modules, including but not limited to text, graphics, logos, button icons, images, audio clips and software, is the property of McComish Holiday Villas and Tara Shannon. None of the data or content found on the Site may be reproduced, republished, distributed, posted, sold, transferred, linked to or modified without the express written permission of the McComish Holiday Villas and Tara Shannon .
In addition, the trademarks, logos and service marks displayed on this Site ("the Trade Marks") are registered and nothing contained in this Site should be construed as granting by implication, estoppel, or otherwise, any licence or right to use any of the Trade Marks without McComish Holiday Villas permission.
All other intellectual property rights (including any patent, copyright, database rights, registered design, trade mark, trade name, know-how or industrial or intellectual property right subsisting anywhere in the world and any applications to protect any of the above) and goodwill in and relating to the Site (including all components developed and produced for the Site including the up-dates, format, art direction, look and feel and content) (the "Intellectual Property Rights") shall be owned by and vest absolutely in McComish Holiday Villas and their web designer Tara Shannon.

However we may use your details to contact you with offers regarding our Villas that we feel you may be interested in.
If at any time you wish to stop receiving such details please e-mail us with your details with 'Unsubscribe' in the subject field or simply contact us.
Information Confidentiality
We will always respect your privacy and any personal communication between you and ourselves. We do not trade, rent or sell your details to any third parties. Should our intentions change it will be done only with your authorisation. We will always comply with any data protection legislation currently in force.
If you have registered your interest with McComish Holiday Villas and/or any of our associated companies, (for example by completing a contact form on the McComish Spanish Holiday Villa site, or sending us an e-mail), and thereby given your consent, you may be contacted with relevant promotions, offers or information that you have expressed an interest in or that might be of interest to you .
With McComish Holiday Villas YOU are always in control of your personal information, if at any time you wish us to stop contacting you then simply contact us.
Looking after your details
At McComish Holiday Villas, we take your privacy seriously, so we promise that:
- We won't use your personal data for any purpose that you have not agreed to, without first letting you know how and why we'd like to use your details. And, of course, we'll make sure that we have your permission first.

We may also consider discounts if you have previously stayed in the Villa at La Torre, or you have previously stayed at our Florida Villa. If any of this applies to you then please mention it when booking.
We may also advertise special offers via this web site from time to time. In which case please mention the relevant offer when booking.
McComish Holiday Villas reserves the right to withdraw or alter any special offers at any time without any prior notice. You cannot use one special offer in conjunction with any other special offer that is available. Special offers are non transferable, and no alternative will be offered to the offer stated. |

The good...
- When using McComishHolidayVillas.com, you might get the odd pop-up box or two! We use these for many reasons, like competition entry forms and questionnaires to help us improve our service to you. You'll know which pop up boxes are from McComishHolidayVillas.com, because they'll be clearly marked with a heading from McComish Holiday Villas.
...and the bad
- You might also get a few pop up ads from third parties. These may appear due to software you have installed, deliberately or unknowingly, on your computer. Unfortunately, we can't control these pop up boxes, because they haven't come from us. We do not endorse any web site or product which appears in any of these pop ups!
