Staying at High Gate House means that you have the 24/7; 365 days a year back up and support of a premier vacation home agency (often referred to in these terms and conditions as the management agents), but also the family touch and personal care provided by The McComish Family.

Your Booking

Please remember that the 'Request to book' form on the Site is not binding and by completing the request to book form your stay at the Villa for the dates requested is not guaranteed. However we will do everything we can to fulfil your request. We will respond to you to advise you whether you have successfully reserved the dates requested.

After making a reservation with us, the party leader must complete our booking form (we will provide you with this) and sign on behalf of all members of the party that these booking conditions together with our general information have been read and accepted.

The accommodation is booked solely for the use of the guests named on the booking form. Due to State fire regulations in Florida, the maximum occupancy as advised by us (10 people) must not be exceeded.

To confirm your booking, we will require a refundable deposit (to be confirmed during the booking process) within 7 days of our verbal confirmation of your arrangements (unless arranged otherwise during the booking process). A higher deposit may be required for premium dates or for longer stays exceeding 4 weeks.

Your booking is confirmed once we have received your deposit and booking form, and the confirmation invoice has been issued by us. No further invoice will be issued, therefore please make a note of the balance due date.

Paying the Balance

The balance of your rental cost is payable 4 weeks prior to your arrival in Florida.

Where payment in full has not been made by this date, we reserve the right to cancel the booking and cancellation charges as detailed to follow, will apply.

If you book within 4weeks, we will require full payment at the time of booking.

Price Guarantee

All prices are subject to change without notice.

Rentals paid for IN FULL at the time of booking will not be subject to any increase or surcharge.

What's included

You have use of the property including all utilities except the pool heating, BBQ and rollaway for which a supplement is payable.

Your holiday home is cleaned and prepared for your arrival. Maid service however is not usual in Florida private homes and it's therefore up to you to keep the property clean and to change and wash bed linen and towels (which are supplied) during your stay.

Your holiday home or condo is available from 4.00PM local time on the day of your arrival.

We ask that you vacate the property by 10.00AM on the day of your departure, leaving it in a tidy condition to enable our cleaners to prepare for our newly arriving guests.

Security Deposits

We understand that accidents do happen, but we do ask that you inform the management company (details provided when booking) of any defects or breakages as soon as possible and pay for the repair or replacement so that neither you nor the following guests are inconvenienced.

On arrival at the property The Management Company will require the payment of a returnable security deposit of $250 in the form of a credit card. This charge will be held to cover or part cover any breakages, excess cleaning costs or damage to the property.

The deposit will be returned within 21 days of the end of the rental period subject to inspection by the management company, less any deductions to cover the cost of replacement or repair. Costs in excess of this amount will be invoiced and payable in full immediately.

Changing Your Booking

Any amendment to a confirmed booking may incur a charge.

Changes within 8 weeks may result in additional cancellation charges.

IF WE CHANGE YOUR BOOKING:

Occasionally it may be necessary for us to amend or cancel your booking through reasons beyond our control and we reserve the right to do so.

We will inform you as soon as possible, and if possible will offer you the choice of alternative accommodation of a similar standard, or a refund of all monies paid, providing it does not arise for reasons of 'Force Majeure'.

Cancellation

If you wish to cancel your booking within the 4 weeks prior to your arrival, your money will not be refunded.

Force Majeure

No liability can be accepted for events, which are 'force majeure'.

These include, but are not limited to: war, threat of war, riots, civil commotion, terrorist activities, industrial disputes, technical difficulties with transportation, natural or nuclear disaster, fire, adverse weather conditions or other events outside our control.

Liability

We accept no liability whatsoever for any injury or loss sustained by guests or any other visitors to the home or swimming pool, or for any loss or damage howsoever caused to any property brought to the premises.

In Case of Complaint

While it is unlikely that you should have a complaint about our Villa, occasionally things do go wrong.

If you have a problem during your stay, you MUST inform the management agency immediately who will endeavour to rectify the matter.

We will not accept liability for any dissatisfaction or other complaint not reported to the local managing agent during your stay.

Insurance

It is vital that you have adequate comprehensive insurance cover for you and all members of your party.

Check that any policies you are considering do in fact cover you for rented accommodation booked independently of travel arrangements.

No responsibility is accepted for any death, illness or loss or damage to property and/or motor vehicles howsoever caused.

Conduct

McComish Holiday Villas and/or the management agents reserve the right to cancel your booking or to terminate your stay if we (McComish Holiday Villas and/or the management agents) believe that your conduct breaches these terms & conditions or we (McComish Holiday Villas and/or the management agents) believe that gross misconduct has occurred.

Departure Documentation

Approximately 30 days before arrival, you will be sent details, giving directions to the vacation home and information on key collection.

Where keys are provided in a 'lock box' facility you will be given a security code. The security code will be needed in order to allow you to access the security box, which holds the keys to your home. The security box is easy to access and can be found at the entrance to the property.

Please remember to take these details with you otherwise access to your vacation home cannot be guaranteed.

Our web site is a guide to the quality and description of our Villa and its facilities.

This property is privately owned and furnished to the owners taste, and changes may be made without notice.

No liability is accepted for unintentional errors, mistakes or omissions, which may arise as a result of subsequent changes.

By using or browsing this site ("the Site"), you have read, understood and agree to be bound by these Terms and Conditions and any other guidelines or rules applicable to other services that may be posted from time to time. If you do not agree with any part of the following terms of conditions you must not use the Site. If you are uncertain, you can always contact us.

Our Obligations

McComish Holiday Villas and their designated Web Developer/Web Development Company (currently Tara Shannon) will provide you with up to date information on the functionality of the Site, and advice and assistance on any upgrades or changes to its functionality; and use reasonable endeavours to comply with any statute, regulation or other ordinance as and when they come into force.

McComish Holiday Villas will respond to any website contact forms (by website contact forms we mean the 'Contact Us' form, 'Request to Book' form, and 'Friends of the McComish Florida Holiday Villa' form) that are received successfully by us. Wherever possible we aim to respond to these website contact forms within 48 hours. Unfortunately however this cannot be guaranteed, but every effort will be made to respond to queries in a timely manner. We can take no responsibility for forms that are not received due to information technology failures that are outside of our control. If you have received no response to you query within 96 hours (4 days) we recommend contacting us again, in case there was a problem with us receiving your original query.

Your Obligations

You agree that you will only use the Site in accordance with these Terms and Conditions and shall ensure compliance with applicable laws and regulations.

You represent, warrant and undertake that you will not cause or permit anything to be done that may infringe, damage or endanger any intellectual property rights of McComish Holiday Villas or any third party.

You agree that you will only use the website contact forms for queries related to the Villa, the surrounding area (Florida) and the Site. You agree not to use any obscene, offensive or threatening language within website contact form queries. We will not respond to queries that do not comply with this rule and reserve the right to cancel your booking.

Exclusion of Warranty

We try to make sure the information contained on this Site is as accurate as possible. However we give no warranty of any kind regarding the Site and/or any materials or information provided on the Site. McComish Holiday Villas does not warrant the accuracy, completeness, currency, or reliability of any of the content or data found on this Site and to the extent permitted by law McComish Holiday Villas expressly disclaims all warranties and conditions, including implied warranties and conditions or merchantability, fitness for a particular purpose and non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade.

McComish Holiday Villas assumes no responsibility and shall not be liable for any damage to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site. In no event shall McComish Holiday Villas be liable for any injury, loss, claim, damage, or any exemplary, punitive, indirect, incidental or consequential damages of any kind (including but not limited to lost profits or lost savings) whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with:

any use of this Site or content found herein
any failure or delay (including, but not limited to) the use of or inability to use any component of the Site
the performance or non-performance by mccomishholidayvillas.com even if such party has been advised of the possibility of damages to such parties or any other party

Any dealings you have with third parties via the Site are your responsibility. Should a dispute arise between yourself and any third party due to use of the Site we will not be responsible for any loss or damage suffered as a result.

We may provide links to other Sites, resources, advertisements or sponsorships either directly or through the contractual partners. McComish Holiday Villas accepts no responsibility for these links and does not endorse their contents. If you decide to access other web sites, you do so at your own risk whatsoever. You shall indemnify and keep McComish Holiday Villas indemnified against all actions, claims, losses, costs (including all legal costs actually incurred or otherwise), damages and expenses that are suffered or incurred by McComish Holiday Villas and any affiliated or associated company or entity whether or not reasonable or otherwise foreseeable or avoidable which arise directly or indirectly from any breach or alleged breach by you of any of these Terms and Conditions.

The Site and each of its modules, including but not limited to text, graphics, logos, button icons, images, audio clips and software, is the property of McComish Holiday Villas and Tara Shannon. None of the data or content found on the Site may be reproduced, republished, distributed, posted, sold, transferred, linked to or modified without the express written permission of the McComish Holiday Villas and Tara Shannon .

In addition, the trademarks, logos and service marks displayed on this Site ("the Trade Marks") are registered and nothing contained in this Site should be construed as granting by implication, estoppel, or otherwise, any licence or right to use any of the Trade Marks without McComish Holiday Villas permission.

All other intellectual property rights (including any patent, copyright, database rights, registered design, trade mark, trade name, know-how or industrial or intellectual property right subsisting anywhere in the world and any applications to protect any of the above) and goodwill in and relating to the Site (including all components developed and produced for the Site including the up-dates, format, art direction, look and feel and content) (the "Intellectual Property Rights") shall be owned by and vest absolutely in McComish Holiday Villas and their web designer Tara Shannon.

Any details entered on this site are subject to international Data Protection laws and will be treated as such. We will not pass your details on to any other companies.

However we may use your details to contact you with offers regarding our Villa that we feel you may be interested in.

We will always respect your privacy and any personal communication between you and ourselves. We do not trade, rent or sell your details to any third parties. At McComish Holiday Villas, we take your privacy seriously, so we promise that:

Friends of the McComish Florida Holiday Villa

By becoming a "Friend of the McComish Florida Holiday Villa" (or "Friend(s)") you are registering your interest with us and are giving us permission to contact you with relevant promotions, offers or information that you have expressed an interest in or that might be of interested to you. Please ensure you have read the Privacy Policy.

"Friends" are entitled to receive a discount on their first booking. The value of the discount is currently set at UP TO £50.00. To qualify for the discount you must be booking the Villa for a minimum of 7 nights. The value of the discount is dependant on the length and time of year of your stay. Please mention when booking that you are a "Friend" and that this is your first booking.

McComish Holiday Villas reserves the right to withdraw or alter this offer at any time without any prior notice. You cannot use this offer in conjunction with any other special offer that is available. This offer is non transferable, and no alternative will be offered if you do not wish to redeem the discount.

Frequent staying "Friends" are also entitled to discounts. The value of these discounts are variable depending on the time of your of the stay, the number of nights you are staying, and how often you have stayed before. Please mention when booking that you are a frequent staying "Friend".

Introductory Special Offer - "Me First"!

To celebrate the launch of our new website we are offering a special deal which is available to the first three customers who book after the launch of the website.

To qualify for this offer you must mention the offer when booking and must quote the special offer reference "Me First"!

The special offer is in the form of a discount, however the value of this discount is dependant on the time of your of your stay, and the length of your booking. Further details will be available when booking.

Whilst we shall endeavour to ensure that the website is updated as soon as the first three bookings have been received we cannot guarantee this, and therefore it is possible that the offer will still be advertised when it is no longer available.

...and the bad

You might also get a few pop up ads from third parties. These may appear due to software you have installed, deliberately or unknowingly, on your computer.
